Well this is probably going to be my last update. They 'think' they fixed it by replacing the ECM. I continued on with the Lawyer. Infiniti had me bring the car in to have a regional technician look at it. I was there maybe a half hour and since the car was working at that time all he did was check for codes and wrote his report that the car wasn't broke at the time - no kidding.
About a week later they sent over an offer to pay me $3500 but that the warranty on the ECM would be null and void. We told them no. And a few days after this the navigation screen went blank and wouldn't come back on - so there are definitely still issues. Infiniti couldn't find anything wrong with the screen because if the car sits long enough it starts to work again and they said it had to be broken when I brought it in....
The Lawyer had me fill out a BBB online complaint. Apparently that worked. Friday we received this email from Nissan USA:

Nissan carefully considered your request during a review of all available facts pertaining to your clients situation. Based on the vehicle repair history, Nissan offers to voluntarily repurchase your client’s vehicle.
In order to coordinate the replacement or repurchase, Nissan needs to know the particular facts pertaining to the ownership and intentions regarding the vehicle. Please return the following documents to me at your convenience, as it will be needed to make a detailed offer:
· 5 Vehicle photos (4 exterior sides photos and 1 interior photo)
· Legible copy of the vehicle’s registration
We anticipate completing the replacement or repurchase within 2 to 4 weeks from the time you accept an offer.
I sent the pictures to the lawyer over the weekend. So my saga is almost over. I'm not sure what they are going to offer to buy this back, I would assume what I paid to date, but I guess we'll find out. It's kind of a shame as I like the car, I just can't trust taking it any distance.
